We participated in the EVALANCHE and RESMEDIA webinar regarding the BGH ruling on cookies on the internet. Another topic was the Privacy Shield, which has been declared invalid by the EuGH and has so far regulated the exchange of data between the USA and Europe.
The big question is, what do you have to pay attention to now?
We have briefly summarised the most important facts:
🍪 In the case of purely functional cookies, an “opt-out”, i.e. an option to object in the website’s privacy policy, is sufficient.
🍪 All other cookies such as advertising and analytics cookies require prior consent
🍪 A default setting of the check mark is not an effective declaration of consent
🍪 Detailed cookie information is to be listed in the privacy policy of the website.
🍪 Imprint and privacy policy are to be linked in the cookie banner
🍪 Declaration of consent for data processing and the use of cookies must also be requested for email marketing
🍪 Data transfers to the USA currently have no legal basis under the GDPR
